Clear terms for a self-service photo order
1. The service and your order
DogPhoto checks eligible photos containing one clearly visible dog, separates the dog from the original background and places the source dog into a selected prepared portrait setting. An order covers the accepted photo count and outputs shown at checkout. It is a one-time purchase, not a subscription.
You must be legally able to enter the contract. The checkout summary, price, selected portrait style, accepted photo count, these terms and the privacy notice form the order description.
2. Photos you submit
You keep your rights in your photos. You grant us a limited licence to store, inspect and process them only to provide, secure and administer your order, meet legal duties, and operate a share page if you separately choose to publish one.
- You must own the photos or have permission to use and process them, including permission for any visible person.
- Do not upload unlawful content, confidential third-party material, or photos that infringe privacy or intellectual-property rights.
- Submit one dog per photo and do not use the service to impersonate another owner, misrepresent an animal, create deceptive evidence or violate another service's rules.
3. Price, tax and payment
The server confirms the exact total before payment. The launch price is €3.99 for the first accepted photo and €0.80 for each additional accepted photo, with VAT included where applicable. Stripe processes the one-time payment and may offer payment methods based on location and eligibility.
A payment return page alone is not proof of payment. Processing begins only after our server verifies the payment event. If the payment is declined, cancelled or not completed, no paid processing starts.
4. Immediate performance and withdrawal
DogPhoto is digital content or a digital service supplied soon after payment. Before ordering, we ask you separately to request immediate performance and acknowledge that, where the law permits, the statutory withdrawal right may be lost once the service has been fully performed or digital content delivery has begun after your prior express consent and acknowledgement.
The acknowledgement is not preselected. If you do not give it, we may be unable to begin immediate processing. Nothing in this section removes rights that cannot lawfully be waived, including remedies for non-conforming digital content or services.
5. Authentic processing and AI disclosure
DogPhoto does not ask an image model to redraw your dog's face, coat, markings or expression. The finished visible dog colour is copied from the uploaded source. Fine fur, whiskers, translucent edges, crop, scale, placement, background, lighting balance and ground shadow may differ.
Prepared portrait settings may be generated with AI and then reviewed. Before payment, bounded local checks confirm one clearly visible dog and block meaningful dog/person overlap. After verified payment, an approved provider may estimate dog transparency; provider colour is discarded before source RGB is composited. If a conforming recognizable result cannot be produced, we reject, replace or refund the affected output instead of inventing hidden anatomy.
6. Delivery, refinements and problems
Estimated processing times are estimates, not guaranteed deadlines. A secure owner link and, when supplied, email recovery link provide access to the result. Each successful image includes the outputs described at checkout and up to two subjective refinements using the available structured reasons. Service defects and failed provider attempts do not consume those refinements.
If an image cannot be delivered in conformity with the order, we may reprocess it, accept a replacement source, or provide a proportionate refund. If no conforming output can be delivered, we provide a full refund. These remedies do not replace any mandatory statutory remedy.
7. Availability, self-service support and responsibility
The service is supplied as an automated, self-service product. We do not promise bespoke retouching, uninterrupted availability, an exact fine-fur cutout, acceptance by a social platform or album printer, or a specific support response time. You remain responsible for reviewing every result before personal use or publication and for keeping an original copy of important photos.
To the fullest extent permitted by law, we are responsible only for losses that are a foreseeable consequence of our breach. Nothing excludes or limits liability where exclusion is unlawful, including liability for fraud, intentional misconduct, gross negligence, death or personal injury where applicable, or mandatory consumer rights.
8. Sharing, suspension and ending access
Results are private by default. If you create a link-only album, anyone with the unguessable URL can see the selected finished images. You can unpublish, rotate or delete it through the owner controls. We may disable unlawful, abusive, security-risk or rights-infringing content and preserve only the minimum evidence required for a legal claim.
We may change or discontinue future service features. Changes do not remove rights already attached to a paid order. The version accepted at checkout remains recorded with that order.
9. Governing law, complaints and contact
Spanish law applies, without depriving an EU/EEA consumer of mandatory protections in their country of residence. Consumers may bring a claim in any court available under mandatory consumer-jurisdiction rules. Contact us first so we can try to resolve the issue; you may also contact your local consumer authority.
